Terms of Service

These Terms of Service ("Terms") govern your use of Darasa Live on WhatsApp and our website. By using the Service, you accept these Terms.

If you do not agree, please do not use the Service.

1. About the Service

Darasa Live is an AI-powered tutor for Kenyan students (Grades 1–9) on the CBC. It includes:

• Tutoring on Mathematics, English, Kiswahili, Science, Social Studies, Creative Arts
• Quizzes, KCPE / KPSEA past paper practice
• Homework help via photo upload
• Progress tracking, gamification (XP, levels, badges)
• Career guidance (Grade 7–9)
• Optional weekly parent progress reports

Darasa Live is an AI tutor, not a replacement for a qualified teacher or school. Students are encouraged to attend school and consult their teachers.

2. Who Can Use Darasa Live

• Intended for students aged 5 to 16 on the Kenyan CBC, and their parents.
• Students under 18 should have parental/guardian permission.
• You must use a valid Kenyan phone number to register for the dashboard.

3. Acceptable Use

You agree to use Darasa Live only for educational purposes. You agree NOT to:

• Bully, harass, or harm others
• Send sexual, violent, hateful, or inappropriate content
• Bypass safety guardrails or jailbreak the AI
• Share your account credentials
• Scrape or overload the Service with automated tools
• Use the Service for commercial purposes without permission
• Pretend to be someone else

4. Account & Registration

• You register by saving the bot's WhatsApp number and sending a message.
• For the dashboard, we verify your phone with a one-time code (OTP).
• Keep your phone secure. We are not responsible for unauthorised access.

5. Subscription & Payments (M-Pesa)

Plans

Prices may change with 30 days' notice via WhatsApp.

Payment Terms

• Payments processed via M-Pesa (Safaricom Daraja API).
• We do not store your M-Pesa PIN or full transaction details.
• Charged to the phone number that initiates the STK Push.

Refunds

• Generally, all payments are final.
• Refund requests must be sent within 48 hours to [YOUR EMAIL].
• Refunds only for technical unavailability on our side, prorated.
• M-Pesa transaction fees are non-refundable.

6. Accuracy & Limitations

• Darasa Live is powered by AI language models. It can make mistakes.
• Always verify important information with your teacher or textbook.
• We are not liable for incorrect answers or academic decisions made based on Darasa Live.
• The Service is provided "as is" without warranties.

7. Intellectual Property

• Lesson content is licensed for your personal study use only.
• You may not republish, sell, or redistribute Darasa Live content.
• The CBC curriculum belongs to KICD; presented under fair educational use.

8. Privacy

Your use is also governed by our Privacy Policy, which describes how we handle your personal data under the Kenya Data Protection Act, 2019.

9. Suspension & Termination

We may suspend or terminate access if you:

• Repeatedly violate these Terms
• Bypass safety guardrails
• Defraud the Service or chargeback payments
• Engage in any illegal activity

You may stop using the Service anytime by sending STOP on WhatsApp.

10. Child Safety

• We cooperate with Childline Kenya (116) and the Department of Children Services.
• If a student appears in distress, we direct them to professional help.
• We do not provide medical, psychological, or legal advice.

11. Liability

To the extent permitted by Kenyan law:

• Total liability is limited to the amount you paid us in the last 3 months.
• We are not liable for indirect or consequential damages.
• Nothing limits any liability that cannot be excluded by law.

12. Changes to These Terms

If we make a significant change, we will notify you via WhatsApp at least 14 days before it takes effect. Continuing to use the Service means you accept the new Terms.

13. Governing Law

These Terms are governed by the laws of Kenya. Disputes are resolved in the courts of Kenya.
